These terms and conditions (the "Agreement") govern your use of: (i) the Gemfolio Platform; (ii) all agreements entered into through the platform; and (iii) all services and products provided by Metfolio Limited trading as Gemfolio ("Gemfolio", "we", "us", "our") through the application and platform. By accessing or using the Gemfolio Platform and its services, you agree to be bound by these terms.
IMPORTANT NOTICE: Gemfolio is a jewellery purchasing platform that allows customers to accumulate jewellery grams towards complete jewellery pieces or purchase jewellery outright. This is not an investment product or platform.
1. Agreement to Terms
By using the Gemfolio Platform and its services, you confirm that you:
Accept and agree to be bound by these terms
Are at least 18 years of age
Have the legal capacity to enter into this agreement
Are a UK resident with a valid UK address
Understand that this is a jewellery purchasing platform, not an investment service
If you do not agree to these terms, you must immediately cease using the Gemfolio Platform and its services.

All references to "Gemfolio" in these terms refer to Metfolio Limited trading as Gemfolio.
3. Definitions
"Jewellery Grams" means units of gold jewellery weight (in 18k or 22k gold) that can be accumulated on the Platform to redeem for complete jewellery pieces from our catalogue.
"Catalogue" means the collection of jewellery pieces available for redemption or direct purchase on the Gemfolio Platform.
"Gemfolio Account" means your unique account containing your personal details, jewellery gram balance, purchase history, and delivery information.
"Gold Jewellery Subscription" means the service allowing customers to accumulate jewellery grams monthly towards specific jewellery pieces from our catalogue.
"Direct Purchase" means purchasing jewellery pieces outright with immediate payment rather than through accumulated jewellery grams.
"Custom Orders" means bespoke jewellery pieces made to customer specifications, not part of our standard catalogue.
"Retail Rate" means the price per jewellery gram set by Gemfolio, which includes our markup and is displayed at checkout.
"Withdrawal Rate" means the rate at which jewellery grams can be exchanged for money, calculated at the prevailing 22k gold spot rate.
"Platform" means the Gemfolio application, website, and any associated APIs.
4. Use of Services
4.1 Service Description
Gemfolio provides a platform for customers to:
Purchase jewellery grams to accumulate towards jewellery pieces
Buy jewellery grams directly as a top-up (minimum £50)
Buy jewellery pieces directly
Redeem accumulated jewellery grams for jewellery from our catalogue
Return eligible jewellery for jewellery gram credits
Withdraw jewellery gram balances for monetary value
4.2 Acceptable Use
You agree to:
Use the services for personal use only
Not use the services for any illegal or unauthorised purpose
Comply with all applicable UK laws and regulations
Not misrepresent the nature of Gemfolio as an investment platform
Provide accurate and truthful information
4.3 Prohibited Activities
You must not:
Use, reproduce, modify, distribute, or sell our services without authorisation
Attempt to gain unauthorised access to our systems
Use the platform for money laundering or fraudulent activities
Create multiple accounts to exploit promotions or returns
Resell jewellery purchased through the platform for commercial purposes
5. Account Registration and Security
5.1 Account Requirements
To use our services, you must:
Provide a valid UK address
Complete identity verification as required
Link a valid UK bank account
Provide accurate personal information
Maintain current contact details
5.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials
You must notify us immediately of any unauthorised access
We are not liable for losses resulting from your failure to secure your account
We may suspend accounts that show signs of suspicious activity
6. Purchasing Jewellery Grams
6.1 Pricing and Rates
Jewellery gram prices are set daily by Gemfolio based on live gold prices plus our markup
The exact number of jewellery grams you receive for your money is displayed at checkout
Prices may fluctuate between adding items to your basket and completing purchase
All prices include VAT where applicable
6.2 Purchase Options
Direct Purchase: Buy jewellery grams as a one-time top-up (minimum £50)
Gold Jewellery Subscription: Monthly recurring purchases (minimum £50)
All purchases subject to the same pricing and terms
6.3 Purchase Process
Purchases are final once confirmed and cannot be cancelled
We reserve the right to refuse any purchase without providing a reason
Payment must be made through verified payment methods linked to your account
Failed payments may result in cancellation of your order
6.4 Ownership
Jewellery grams in your account remain the property of Gemfolio until redeemed for jewellery or withdrawn
Delivered jewellery becomes your property upon successful delivery
7. Gold Jewellery Subscription
7.1 Subscription Structure
Gold Jewellery Subscription allows monthly accumulation of jewellery grams towards specific pieces
Minimum monthly contribution is £50
You can pause, resume, or cancel subscriptions at any time without penalty
Subscriptions are not contracts and create no obligation to continue
7.2 Subscription Management
You can modify your monthly contribution amount above the minimum
Multiple subscriptions can run simultaneously
Accumulated grams can be redirected to different jewellery pieces
We may cancel or modify subscription offerings with 30 days' notice
8. Direct Jewellery Purchases
8.1 Purchase Terms
Jewellery can be purchased outright at current catalogue prices
Prices are displayed in GBP and include all applicable taxes
Payment is required in full at time of purchase
Order confirmation will be sent via email
8.2 Availability
Catalogue items are subject to availability
We reserve the right to limit quantities
Discontinued items may not be available for gram redemption
9. Delivery
9.1 Delivery Process
UK delivery only
Free standard delivery on all orders
Delivery address must match your verified account address
Signature required on delivery
9.2 Delivery Liability
Our responsibility ends when jewellery is handed to the delivery carrier
We are not liable for delays caused by third-party carriers
Risk of loss transfers to you upon delivery
You must inspect packages and report damage immediately
9.3 Failed Delivery
Undelivered items will be returned to us
Redelivery may incur additional charges
We are not responsible if no one is available to receive delivery
10. Returns and Refunds
10.1 Jewellery Gram Credit Returns (30-Day Policy)
For jewellery purchased with jewellery grams:
Returns accepted within 30 days of delivery
Returned items credit jewellery grams to your account
Items must be unworn, undamaged, with all original packaging
Return shipping costs are your responsibility
10.2 Non-Returnable Items
The following items CANNOT be returned for hygiene and safety reasons:
Nose rings, nose studs, nose pins, and all nose jewellery
Earrings, ear studs, ear hoops, ear cuffs, and all ear jewellery
Custom-made or personalised jewellery
Engraved items
Any item showing signs of wear or damage
10.3 Direct Purchase Refunds
For jewellery bought with direct payment:
Full refund to original payment method within 30 days
Subject to same return conditions and exclusions as above (including nose and ear jewellery)
Refunds processed within 5-7 business days of receipt
10.4 Return Process
Contact customer service to initiate returns
Use provided prepaid label (where applicable)
Include all original documentation
We reserve the right to refuse returns not meeting these conditions
11. Jewellery Gram Withdrawals
11.1 Withdrawal Terms
Jewellery grams can be withdrawn for monetary value
Withdrawal rate based on current 22k gold spot price
Minimum withdrawal amount: 1 gram
Withdrawals processed to your nominated bank account
11.2 Processing
Withdrawal requests processed within 3-5 business days
We reserve the right to delay withdrawals for security verification
Withdrawal rates locked at time of request confirmation
No cancellation once withdrawal is confirmed
12. Intellectual Property
All intellectual property rights in the Gemfolio Platform, including but not limited to:
Trademarks, logos, and brand names
Jewellery designs and catalogues
Software and application design
Content and marketing materials
remain the exclusive property of Metfolio Limited. You may not use, reproduce, or distribute any intellectual property without our written consent.
13. Data Protection and Privacy
13.1 Personal Data
We collect and process:
Contact information (name, address, email, phone)
Identity verification documents
Payment information
Transaction history
Communication preferences
13.2 Data Protection Compliance
We comply with UK GDPR and Data Protection Act 2018

13.3 Marketing Communications

Transactional emails cannot be opted out of

14. Liability and Disclaimers

Fluctuations in gold prices or jewellery gram values
Loss or damage after delivery
Indirect or consequential losses
Loss of anticipated savings
Loss of business or profits
Events beyond our reasonable control (force majeure)
14.2 Maximum Liability
Our maximum liability to you is limited to:
For jewellery gram purchases: the amount paid for those grams
For direct purchases: the purchase price of the item
For delivery issues: the cost of replacement delivery
14.3 Statutory Rights
Nothing in these terms excludes or limits liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any liability that cannot be excluded under UK law
Breach of your statutory rights as a consumer
15. Consumer Rights
15.1 Statutory Rights
Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms, including:
Goods must be of satisfactory quality
Goods must be fit for purpose
Goods must match their description
Rights to reject faulty goods

16. Account Termination
16.1 Your Right to Close
You can close your account at any time
Outstanding jewellery gram balances will be withdrawn at current rates
Pending orders must be completed or cancelled
16.2 Our Right to Terminate
We may suspend or terminate your account if:
You breach these terms
We suspect fraudulent activity
Required by law or regulation
You provide false information
You abuse our returns policy
16.3 Effect of Termination
Access to platform immediately ceased
Outstanding balances settled within 30 days
No refund of completed purchases
Data retained per legal requirements
17. Changes to Terms
17.1 Modifications
We may update these terms at any time
Material changes notified via email with 30 days' notice
Continued use constitutes acceptance
Current terms always available on platform
17.2 Pricing Changes
Jewellery gram rates change daily
Catalogue prices may change without notice
Prices locked once purchase completed
18. General Provisions
18.1 Entire Agreement
These terms constitute the entire agreement between you and Gemfolio.
18.2 Severability
If any provision is found unenforceable, the remainder continues in effect.
18.3 Waiver
Failure to enforce any right does not constitute a waiver.
18.4 Assignment
You cannot transfer your rights under these terms. We may assign our rights to any successor.
18.5 Third Party Rights
These terms do not create any third-party beneficiary rights.

Official notices must be sent to our registered office address.
19. Governing Law and Jurisdiction
19.1 Applicable Law
These terms are governed by the laws of England and Wales.
19.2 Jurisdiction
The courts of England and Wales have exclusive jurisdiction over any disputes.

Before court proceedings, consider alternative dispute resolution options available to UK consumers.
